Terms and Conditions 

D'abord le travail, ensuite le plaisir.

1 SCOPE
1.1 These terms and conditions apply to contracts for the rental of the "Amour Fou" apartment and all other services and deliveries of the apartment provided for the customer in this context.
1.2 General terms and conditions of the customer only apply if this has been expressly agreed beforehand.


2 CONCLUSION OF CONTRACT, PARTNERS, STATUTE OF LIMITATIONS
2.1 Contractual partners are the apartment and the customer. The contract is concluded by the apartment's acceptance of the customer's application. The apartment is free to confirm the booking in text form.
2.2 All claims against the apartment expire one year after the start of the statutory limitation period. Claims for damages become statute-barred in five years, depending on knowledge, insofar as they are not based on injury to life, limb, health or freedom. These claims for damages become time-barred after ten years, regardless of knowledge. The shortening of the limitation period does not apply to claims based on an intentional or grossly negligent breach of duty by the apartment hotel.


3 SERVICES, PRICES, PAYMENT, OFFSET
3.1 After confirmation of the firm booking, the apartment is obliged to keep the rooms booked by the customer available and to provide the agreed services.
3.2 The customer is obliged to pay the agreed or applicable prices of the apartment for the room rental and the other services used by him. This also applies to services commissioned by the customer directly or via the apartment, which are provided by third parties and paid for by the apartment.
3.3 The agreed prices include the taxes and local duties applicable at the time the contract is concluded.
3.4 Invoices for the apartment without a due date are payable without deduction within seven days of receipt of the invoice. The apartment can demand the immediate payment of due claims from the customer at any time.
3.5 The apartment is entitled to demand an appropriate security deposit from the customer upon conclusion of the contract.  

4 WITHDRAWAL BY THE CUSTOMER (CANCELLATION)
FAILURE TO USE THE SERVICES OF THE APARTMENT (NO SHOW)
4.1 Cancellation by the customer of the booking without stating a reason for the reasons set out in Section 4.2. regulated conditions possible.

4.2 Customer Cancellation Deadlines

If a cancellation is made up to 5 days before the respective booking slot, this is free of charge.

For cancellations and rebookings under 5 days, please contact us by phone or email and we will try to find a solution. We generally charge a flat rate of €10 for processing.


5 WITHDRAWAL OF THE APARTMENT
5.1 If it has been agreed that the customer can withdraw from the contract free of charge within a certain period of time, the apartment is entitled to withdraw from the contract during this period if there are inquiries from other customers about the contractually booked rooms and the customer, upon inquiry by the apartment, with reasonable setting a deadline does not waive his right to withdraw.
5.2 Furthermore, the apartment is entitled to extraordinarily withdraw from the contract for an objectively justifiable reason, in particular if
- Force majeure or other circumstances for which the apartment is not responsible make it impossible to fulfill the contract;
- Rooms are booked culpably with misleading or false information or with the concealment of essential facts; The identity of the customer, the ability to pay or the purpose of the stay can be essential.
- the apartment has justified reason to assume that the use of the service can endanger the smooth running of business, the security or the reputation of the apartment in public, without this being attributable to the area of control or organization of the apartment;
- the purpose or reason for the stay is illegal;
5.3 The justified cancellation of the apartment does not justify the customer's claim for damages


6 LIABILITY OF THE APARTMENT
The tenant is always responsible for all actions taken on the premises, which take place within the agreed booking time. The tenant is liable for damage to people or objects belonging to the apartment and must assume the damage incurred. Damage must be reported in writing or by telephone immediately after the end of the rental period.

Should disruptions or defects occur in the services of the apartment, the apartment will endeavor to remedy the situation if it becomes aware of it or if the customer complains immediately. The customer is obliged to do what is reasonable for him to remedy the disruption and to keep possible damage to a minimum.

 

7 FINAL PROVISIONS
7.1 Changes and additions to the contract, the acceptance of applications or these General Terms and Conditions should be made in text form. Unilateral changes or additions by the customer are invalid.
7.2 German law applies. The application of the UN sales law and the conflict of laws is excluded.
7.3 Should individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. In addition, the statutory provisions apply.

The house rules are part of the general terms and conditions.

Smoke

Smoking is prohibited in all areas of the apartment and in the direct outdoor area.

pets

Pets are not allowed in the entire apartment.

outdoor areas & noise protection

Please note that the entire outdoor area is not a play area. It is important to ensure that you wear proper clothing and that you behave accordingly.

The windows and doors must be kept closed at all times!

number of people

The apartment is primarily reserved for private couples, accordingly the number is limited to two people. The stay of each additional person must be announced to the landlords and confirmed by them.

damage

Our apartment is equipped with high-quality SM furniture, so we ask you to treat it with care and caution. Should there be any damage, please let us know immediately, at the latest after you have left the apartment. Please be honest about this in order to avoid misunderstandings and to find an adequate solution together. You are fully liable for grossly negligent damage (see also our General Terms and Conditions). Our apartment is checked after each booking and any damage can be assigned to the respective booking.

Please pay special attention to the pipes throughout the room. Under no circumstances may these be used as a play opportunity, as this can lead to considerable damage.

Property

All items and facilities remain where they are found. However, should you accidentally or misleadingly pack an item that belongs to the apartment, please contact us. In return, we will also contact you directly if we find an item you forgot during the subsequent cleaning. We will send this to you immediately.

protection of minors

Access to the apartment is restricted to people over the age of 18 only.

Commercial use

The prices indicated at the time of booking are only valid for private individuals. Commercial use, e.g. for photo or video recordings, escorts, professional dominatrixes, etc. require prior agreement and approval by the landlord.
